Yahoo, Facebook settle patent dispute,? | Advanced E-Commerce ...

SAN FRANCISCO (AP) ? Facebook and Yahoo have agreed to settle a patent dispute, averting a potentially lengthy battle over the technology running two of the Internet?s most popular destinations.

In dropping the lawsuits, the companies agreed to license their patents to each other. They are also agreeing to an advertising alliance that expands their existing partnership.

The advertising alliance could help Yahoo recover some of the revenue that it has been losing as marketers shift more of their spending to a larger and more engaged audience on Facebook?s online social network.

Friday?s settlement involves no exchange of money and comes after a months-long patent squabble between the two Internet icons.

The truce ends a conflict provoked by Yahoo?s short-lived CEO, Scott Thompson, who was dumped from the job two months ago after misinformation on his official biography raised questions about his integrity.

Under Thompson, Yahoo filed the patent lawsuit in March, wielding it as a weapon against a company that Thompson believed had been prospering from the ideas of its older rival. The complaint alleged that Facebook infringed on 10 Yahoo patents covering Internet advertising, privacy controls and social networks. Yahoo Inc. added two more patents to the lawsuit later.

But Thompson?s attack on Facebook Inc. quickly turned into a public-relations disaster. Much of the technology industry railed against Yahoo?s tactics. Critics viewed the lawsuit as a financial shakedown by a desperate company whose well of innovation had run dry.

New York venture capitalist Fred Wilson summed up the enmity toward Yahoo in an acerbic blog post that ended with this denouement: ?I am writing this in outrage at Yahoo. I used to care about that company for some reason. No more. They are dead to me. Dead and gone. I hate them now.?

When Yahoo replaced Thompson in May with interim CEO Ross Levinsohn, it opened the door for the company to settle the dispute under a reshuffled board of directors. Six of Yahoo?s 11 directors joined the board after Yahoo sued Facebook on March 12.

Yahoo?s legal assault had exposed Facebook?s vulnerability to patent claims as it prepared to complete the biggest initial public offering of stock by an Internet company.

Facebook insulated itself by buying 750 patents from IBM Corp. and spending $550 million to acquire an additional 650 patents that one of its biggest shareholders, Microsoft Corp., had purchased from AOL Inc. Armed with its own arsenal of intellectual property, Facebook signaled that it wasn?t backing down and filed its own lawsuit against Yahoo in April for patent infringement.

With the agreement, Yahoo and Facebook revert to the amicable relationship that they had been fostering before the lawsuit. And it appears the antagonism is dissolving into a partnership that could benefit both companies.

Yahoo already has been tying many of its services and content to Facebook before the lawsuit was filed. Now it plans to cross-pollinate some of its advertising with Facebook and feed even more of its coverage of major events to the social network.

Although it has been growing at a robust clip, Facebook is still trying to win over skeptical investors. Doubts about the company?s revenue potential have weighed on Facebook?s stock, which has remained well below its IPO price of $38. The stock gained 26 cents, or nearly 1 percent, to close Friday at $31.73.

Yahoo is trying to snap out of a long-running financial funk brought up by Facebook?s success and Google Inc.?s dominance of Internet search and advertising.

As revenue fell, Yahoo has gone through four fulltime CEOs in five years in hopes of engineering a turnaround. The foibles have depressed Yahoo?s stock, frustrating shareholders still angry about a squandered opportunity to sell the entire company to Microsoft in May 2008 for $47.5 billion, or $33 per share.

The stock dipped 7 cents to close at $15.78.

The Facebook pact could improve Levinsohn?s chances of being anointed as Yahoo?s permanent CEO. Citing unnamed people familiar with the matter, All Things D reported that Levinsohn is a finalist for the job, though Yahoo has also seriously considered Jason Kilar, CEO of online TV service Hulu.com.

Eight years later, Scott Peterson files death sentence appeal

Death penalty lawyer Cliff Gardner filed the 423-page document Thursday.

A San Mateo County jury found the former fertilizer salesman guilty of killing his wife Laci and dumping her in the San Francisco Bay on Christmas Eve 2002.

Peterson?has always maintained his innocence and his appeal to the Supreme Court is no different. Gardner claims that the overwhelming publicity?Peterson's?trial received, incorrect evidentiary rulings and other mistakes deprived him of a fair trial.?Peterson?was convicted in 2004 after a trial that his attorney argues surpassed the O.J. Simpson murder trial in terms of publicity.

Peterson?claims that Laci was killed sometime after he left their Modesto home the morning of Dec. 24, 2002 to go fishing in the San Francisco Bay. Gardner notes that?Peterson?was convicted and sentenced to death even though investigators never directly proving "how, where or when" the murder occurred.

Prosecutors told the jury that Laci was killed sometime between the night of Dec. 23, 2002 and the morning of Dec. 24, 2002. They believed Laci was suffocated in her home, but Gardner argues that there was little direct evidence collected at the house to support that theory.

Gardner argues that the intense publicity the case generated almost from the moment Laci disappeared deprived?Peterson?of a fair trial. The trial was ordered moved from Stanislaus County of the?Petersons' home, to San Mateo County. Gardner argued that the trial should have been moved yet again because of the crush of publicity in San Mateo County.

"Before hearing even a single witness, nearly half of all prospective jurors admitted they had already decided Mr.?Peterson?was guilty of capital murder,' Gardner argues. And in what may be a first for the American system of justice, outside the courthouse in which the parties would try to select a fair jury, a radio station posted a large billboard which had a telephone number for people to call in and vote" whether?Peterson?was a "man or monster."?Peterson?was pictured in an orange jailhouse jumpsuit.

"The publicity continued throughout trial," Gardner argued. "A mob estimated at more than 1,000 people gathered at the courthouse to await the guilt phase verdict. After the guilty verdict was announced, the 12 jurors departing to await the beginning of the penalty phase ? and decide whether Mr.?Peterson?would live or die ? were met with wild applause and cheering."

Beyond issues with the publicity, Gardner argues the judge made several erroneous evidentiary decisions and other rulings that led to?Peterson?receiving an unfair trial. Gardner complains the judge automatically excluded prospective jurors who said they opposed the death penalty. Gardner argued that those jurors should have been questioned more about whether they could still decide the case fairly.

Gardner also argues that some of the prosecution's strongest evidence should never have been shown to the jury. For instance, Gardner alleges that the police dog who picked up Laci's scent at the Berkeley Marina "even though the dog had a dismal record of being wrong a remarkable 66 percent of the time."

The thick legal brief delves into numerous other issues alleging incorrect rulings, juror misconduct and other errors.

All death penalty cases are appealed to the California Supreme Court, which is struggling to keep up with the pace of cases. There are 725 inmates on Death Row and no prisoner has been executed in California since January 2006. Lawsuits in federal and state courts have temporarily halted executions.

The appeal is expected to take months, if not years, to be resolved.

High school football coach walks three days for local veterans

A high school football coach is honoring our veterans this 4th of July by marching around the Kern Veterans Memorial for three days straight.

Marc Sandall grew up in Bakersfield and now lives near Paso Robles.?Sandall hopes his trek in Kern County will raise awareness about veterans' mental health issues and their high suicide rate.

As we celebrate our nation's birthday on July 4th, Sandall is walking for our wounded warriors. "I think we are not taking care of those who are taking care of us," he explained.

Sandall isn't a veteran himself. He used to send care packages to our troops overseas, but he wanted to do more.

Iraq war veterans Jeremy Staat's and Wesley Barrientos' cross-country adventure from Bakersfield to Washington D.C. inspired?Sandall to find another way to help. "I said there's gotta be something a little guy like I can do," he said.

On Tuesday, Marc started his three-day walk around the Kern Veterans Memorial in downtown Bakersfield.

"It just shows the mission we started is starting to take root. It's exactly what we wanted," said?Staat, an Iraq War Veteran.

As Sandall finishes each lap, he is reminded of the reason he is on this journey. One out of every two veterans waits longer than 50 days for a mental health evaluation. Each day, 18 veterans commit suicide.

"We need to do our part collectively to say, 'hey come on back, you're a hero and we want to take care of you'," continued Sandall.

Former Marine and Vietnam veteran Chuck Bikakis spent 14 years working at the Kern County Veterans Service Department.

"It's not acceptable. I guess you could say that's the way the system is, it's the government. The procedure is inefficient. Someone needs to take a look and say why does it take us so long to process a claim," said Chuck Bikakis.

Even though Sandall's feet are ready to give out, he keeps walking to help those who keep us free.?"I want to take them off and put new ones on," he noted. "I know there's an end to this, and someday I hope there's an end to our vets' situation."

Sandall is encouraging people at the memorial to sign letters to lawmakers, asking them to speed up the counseling and care process for our veterans. He will be at the Kern Veterans Memorial on Truxtun Avenue until Thursday night.

(AP) ? Casey Anthony's attorney said he strongly considered early in the case whether she should plead guilty to a lesser charge to avoid the death penalty if convicted of murdering her 2-year-old daughter Caylee, but Anthony adamantly insisted she had nothing to do with the toddler's death.

In his just-published book "Presumed Guilty, Casey Anthony: The Inside Story," attorney Jose Baez said prosecutors offered in 2008 to allow Anthony to plead guilty to aggravated manslaughter of a child and serve up to 13 years in prison. Baez said in an interview with The Associated Press that in those early days he thought taking it might be in Anthony's best interest.

"There were times, difficult times, when the evidence didn't look good for Casey," Baez said, adding that it was his obligation as a lawyer to convey any such plea offers.

Anthony, he said, "would not entertain it for a second." As he became more familiar with the state's mostly circumstantial case, Baez said he grew convinced she would be acquitted by a jury ? as she was a year ago Thursday of all charges except for four misdemeanors of lying to investigators.

"There was nothing in the trial that ever made me think Casey was guilty of anything as related to the murder," Baez said. "Every single piece of evidence favored us."

Prosecutors claimed Anthony suffocated Caylee with duct tape so she could spend time with her boyfriend and be free for Orlando's nightlife. Baez said during the trial ? repeated again in his book ? that Caylee accidentally drowned in a family swimming pool and that her father, George Anthony, hid the body. Baez also claimed George Anthony sexually abused his daughter.

George Anthony denied both allegations, and there was little brought up about them during the trial. Baez said the defense wasn't required to put on any such evidence because proving the case is the prosecution's burden, not the other way around.

Evidence and testimony showed that Anthony was a habitual liar, even making up fake friends and pretending every day to go to a job she didn't have. Baez was asked whether Anthony's lies surrounding her daughter's disappearance might be indicative that she was guilty.

"I don't think the lies are indicative of innocence or guilt," he said. "The lies were there long before Caylee passed away." In the book, he says Anthony had built a "fantasy world," and her lies weren't evidence of guilt but signs of someone with "serious mental health issues."

Baez said one piece of prosecution evidence he was most concerned about was that police cadaver dogs had indicated a body may have been in the trunk of Anthony's car at one point and also that a body may have been in the backyard. None was discovered in the backyard and there was nothing but rotting bags of trash in the trunk.

But, he said, people ? and jurors ? believe in dogs.

"That concerned me a little bit. Most people really think dogs can do magic," Baez said.

The prosecution's flaw, he added, was that regarding the car search the dog and handler were focused only on Anthony's vehicle and did not include others in a lineup to give the dog options.

Overall, Baez attributed the strong public backlash against the jury's verdict to a lack of understanding about the judicial system and because "a lot of people bought into the hype" that Anthony must have been guilty. He noted that jurors who gave media interviews after the trial said they waited for weeks for strong evidence that never came.

"We need to talk about whether an actual murder occurred," he said. "That's where the focus should have been, and it never was."

Baez declined to comment on what Anthony is doing these days and on how often he talks to her. He said he promised her confidentiality when she agreed that he could write his book, in which she did not participate. Anthony is living in an undisclosed location in Florida serving probation for an unrelated conviction, which Baez said ends on Aug. 21.

"She's doing a lot better than she was in prison," Baez said, but then added: "She's a prisoner of her own freedom."
